ArtFag Mafia Cardholder Agreement and Waiver In consideration of the services and facilities of the ArtFag Mafia and it’s agents, officers, volunteers, participants, employees, affiliates and all other persons or entities acting in any capacity on the their behalf (hereinafter collectively referred to as “AFM”), hereby agree to release, indemnify and discharge AFM on behalf of myself, my children, my parents, my heirs, assigns, personal representative and estate as follows. I acknowledge that my participation in AFM subjects me to danger, and that this risk cannot be eliminated without jeopardizing the essential qualities of these activities. AFM activities expose their participants to the usual risks of cuts and bruises, inhalation, fatigue, or noise; however, more serious risks exist as well. Participants can fall off equipment, sprain or break limbs, and can suffer more serious injuries, and even death. In any event, if you are injured, you may require medical assistance, which you will have to pay for at your own expense. Furthermore, AFM members have difficult jobs to perform and cannot prevent all accidents. They try to minimize the risk, but accidents will happen. By signing this agreement, I am waiving any claims against AFM for negligence and expressly assume the risk of injury because of negligence or failure of equipment. I expressly agree and promise to accept and assume all of the risks existing in AFM activities. My participation in AFM activities is purely voluntary, and I elect to participate in spite of the risks. I expressly agree not to engage in any illegal activity of any type at any function or event of AFM or on the property of where the event is held. I agree not to possess, distribute, or use any controlled substance at any AFM event. I agree to not use any threat or coercion, unauthorized, harmful, or offensive conduct with any other person nor be involved in any act that may endanger the health and well being of any other person present at any function or event of the AFM. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless AFM from any and all claims, demands or causes of action, which are in any way connected with my participation in AFM activities of my use of AFM equipment or facilities, including any such claims which allege negligent acts or omissions of AFM or failure of its equipment. I appoint AFM as my representative to take actions necessary to protect my intellectual property or privacy writes, recognizing that AFM has no obligation to take any action whatsoever. Should AFM or anyone acting on their behalf be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs. I agree to arbitration and mitigation and waive my right to bring a lawsuit against AFM. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have. I expressly acknowledge, agree, and consent to be exposed to and observe conduct consistent with the purpose of AFM. This conduct includes dangerous conditions and nudity. I further agree that the above-mentioned behavior and activity is not offensive to me, nor is it considered lewd or lascivious by me. I agree as does AFM, that absent a valid court order, both me and AFM will maintain the privacy of all members. I agree not to reveal the identity or release any information about any member or former member of AFM to any non-member. I understand that there are potentially dangerous areas and conditions in underground venues. I will strictly obey all posted warning signs and I will not enter restricted areas. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect. By signing this agreement, I acknowledge that if anyone is hurt or property is damaged during my participation in AFM activities, I have waived my right to maintain a lawsuit against AFM. I further attest that I am not attending any and all AFM functions in any official capacity other than a private club member. My signature heron is to signify that I enter into any AFM activity of my own free will and that I fully and unconditionally release AFM, it’s owners and officers and/or any other individual associated with AFM from criminal or civil liability. I acknowledge that I have had sufficient time to read this entire agreement and I understand all of it.
